- Acceptance of Terms
LinkedMarts Limited, provides LinkedMarts Limited services (defined below) subject to the following Terms of Service (“TOS”). By using LinkedMarts Limited’s services, it is presumed that you have read, understood, and agree to be bound by the terms and provision of the TOS. In addition, when using particular LinkedMarts Limited services, you and LinkedMarts Limited shall be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules (including but not limited to our Spam Policy) are incorporated by reference into the TOS.
LinkedMarts Limited reserves the right to revise or update the content of the TOS at any time. Therefore, it is recommended that you review the TOS regularly. By continuing to use our services after any revision or updates to the TOS, it is presumed that you have read, understood, and agreed to the revisions or updates. If you do not agree with the content of the TOS, or your country or area excludes our TOS, please stop using our services immediately.
If you are under 18 years of age, and you use or continue to use our services, it is presumed that a parent or legal guardian has read, understood, and agree to the content of the TOS and its subsequent revisions or updates.
2. Links to Third Party Websites
LinkedMarts Limited or companies that help us provide services may provide links to external websites or online resources. By clicking on third party links on LinkedMarts Limited’s platforms, you acknowledge and agree that LinkedMarts Limited is not associated with, responsible for, or endorses any content, advertising, products, or other materials on or available from such sites or resources. All external websites operated by third parties are the sole responsibilities of their web operators and therefore beyond LinkedMarts Limited’s control and responsibility. LinkedMarts Limited cannot guarantee the appropriateness, reliability, timeliness, effectiveness, correctness, and completeness of external websites.
3. Your Registration Obligations
In consideration of your use of LinkedMarts Limited’s services, you agree to: (a) provide true, accurate, current, and complete information about yourself as prompted by LinkedMarts Limited’s registration form; and (b) maintain and promptly update the above-mentioned information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or there is reason to suspect so, LinkedMarts Limited has the right to suspend or terminate your account and deny your use of all, or part, of our services.
4. User Account, Password, and Security
Upon completing the registration process for using our services, you are responsible for maintaining the confidentiality of your account and login details (username and password). In addition, you agree to (a) immediately notify LinkedMarts Limited of any unauthorized use of your account or account login or any other breach of security; and (b) ensure that you log out from your account at the end of each session.
5. Delivery
The dispatch date is set within 2 days after the product is ordered.
6. Terms of refund, replace and cancellation
Since LinkedMarts Limited serves as a medium connecting vendors and users. Thus, all the final decisions related to refund, replace and cancel terms are made by the vendors.
5. Your Content
By creating, uploading, posting, sending, receiving, storing or otherwise making available any of Your Content (collectively, “Content”), including but not limited to, text, images, videos, reviews and comments, on or through LinkedMarts Limited services, you represent and warrant that you have all rights and/or consents that are necessary to grant to LinkedMarts Limited the rights to such Content, as contemplated under the TOS.
You hereby grant LinkedMarts Limited a non-exclusive, worldwide, royalty-free license, irrevocable, perpetual, with the right to sublicense and transferable license, to use, copy, modify, prepare derivative works, translate, distribute, license, restore, transmit, adapt or otherwise exploit such Content on, through, or by means of our services. LinkedMarts Limited may use Content to promote LinkedMarts Limited or our Services in general, in any format and through any channels, including but not limited to email, third-party websites or advertising mediums.
You acknowledge and agree that you are solely responsible for all Content that you make available on, through or by means of our services, and that you will indemnify LinkedMarts Limited for all claims resulting from Content you supply. You represent and warrant that the Content will not infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights, other proprietary, intellectual property rights, rights of publicity or privacy, or result in the violation of any applicable law or regulation.
To assist members who speak different languages, Content may be translated, in whole or in part, into other languages. LinkedMarts Limited services may contain translations powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and noninfringement. LinkedMarts Limited also cannot guarantee the accuracy or quality of such translations, and you are responsible for reviewing and verifying the accuracy of such translations.
6. Protection of Minors
The Internet contains information that is not suitable for minors, such as those containing pornographic or violent content, which may result in mental, spiritual, or physical harm to minors. Therefore, in order to ensure safety on the Internet for minors, and to avoid privacy breaches, a minor’s parent or legal guardian shall have the obligation to:
(a) Review the Privacy Policy of the website, and decide whether they agree to provide the requested personal data. The parent or guardian should regularly remind their children that they should not disclose any information on themselves or about their family (including name, address, contact number, email address, pictures, credit or debit card numbers, etc.) to anybody. In addition, they should not accept any invitations or gifts from friends they only communicate with online, or agree to meet such friends alone. (b) Be cautious in selecting suitable websites for minors. Children under 12 years of age should only use the Internet under full supervision. Minors over 12 years of age should only visit websites for which a parent or legal guardian has already given approval.
7. User’s Legal Obligation and Commitment
You agree to never use LinkedMarts Limited’s services for any illegal purpose or in any unlawful manner, and undertake to comply with related laws of HKSAR and all international practices for Internet use. By purchasing alcohol on LinkedMarts, you hereby declare that you are 18 or above. If you are a user outside the HKSAR, you agree to comply with the laws of your country or region. You agree and pledge not to use LinkedMarts Limited’s services to infringe on the rights or interests of others, or for any illegal conduct. You agree not to use LinkedMarts Limited’s services to:
(a) upload, post, publish, email, transmit, or otherwise make available any information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content”) that is libelous, defamatory, unlawful, harmful, threatening, abusive, harassing, tortious, vulgar, obscene, false, invasive of another’s privacy, hateful, or that violates or incites violation of public order, or that is racially, ethnically, or otherwise objectionable; (b) upload, post, publish, email, transmit, or otherwise make available any Content that violates or infringes on another person’s reputation, privacy, trade secrets, trademark, copyright, patent rights, other intellectual property rights, or other rights; (c) upload, post, publish, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law, or under contractual or fiduciary relationships; (d) impersonate any person or entity including using another person’s name to use our services; (e) upload, post, publish, email, transmit, or otherwise make available any material that contains software viruses, or any other computer code, files, or programs designed to interrupt, damage, or limit the functionality of any computer software, hardware, or telecommunications equipment; (f) engage in illegal transactions, post false or erroneous messages, or post message that induce others to commit crimes; (g) upload, post, publish, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas that are designated for such purpose; (h) harm minors in any way; (i) forge headers or otherwise manipulate identifiers to disguise the origin of any Content transmitted through our services; (j) interfere with or disrupt the our services, or servers or networks connected to our services, or disobey any requirements, procedures, policies or regulations of networks connected to our services including using any device, software or routine to bypass our robot exclusion headers; (k) “stalk” or otherwise harass another, or collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs “a” through “j” above; and/or (l) to conduct any other activity or behavior that LinkedMarts Limited sees as inappropriate on reasonable grounds.
8. System Interruptions or Breakdowns
When accessing LinkedMarts Limited’s services, you may at times encounter interruptions or breakdowns. This may lead to inconvenience during use, loss of information, errors, unauthorized alteration, or other economic losses. We advise that you take protective measures when using our services. LinkedMarts Limited will not be liable for any damage caused by your use (or inability to use) our services, unless it is caused by us intentionally or due to gross negligence on our part.
9. Information or Suggestions
LinkedMarts Limited does not guarantee the complete correctness and accuracy of information or suggestions acquired from your use of our services or other websites connected to our services (including but not limited to business, investment, medical, or legal information or suggestions). LinkedMarts Limited reserves the right to modify or delete at any time any information or suggestion provided under our services. Before making plans and decisions based on information or suggestions obtained from our services, you must obtain professional advice in keeping with your individual requirements.
LinkedMarts Limited may cooperate at any time with third parties (“Content Providers”), which may provide news, information, articles, video, e-newsletters, or activities for posting on LinkedMarts Limited. LinkedMarts Limited will state the Content Provider in all cases at the time of posting. Based on the principle of respect for the intellectual property rights of Content Providers, LinkedMarts Limited shall not perform any substantial review or revision of content from such Content Providers. You should make your own judgments concerning the correctness or authenticity of such content. LinkedMarts Limited shall not be held liable for the correctness or authenticity of this type of content. If you feel that certain content is inappropriate, infringes on others’ rights, or contains falsehoods, please directly contact the Content Provider to state your views.
10. Ad
All advertising content, text or picture descriptions, display samples, or other marketing information that you see when using our services (“Advertisement”), are designed and provided by their advertising companies, or product or service suppliers. You should exercise your own discretion and judgment about the correctness and reliability of any Advertisement. LinkedMarts Limited only posts the Advertisement. LinkedMarts Limited shall not assume responsibility for any Advertisement.
11. Sales or Other Transactions
Suppliers or individuals may use our services to buy and/or sell (trade) products, services, or other transactions. If you engage in any transaction, the trade or other agreement exists between only you and the supplier or individual. You should request from such suppliers or individuals to provide prior detailed explanations and descriptions of their products, services, or other object of transaction in terms of the quality, content, shipping, warranty, and liability for warranty against defects. In case of any dispute arising out of a trade, service, or other transaction, you should seek remedy or resolution from the relevant supplier or individual.
12. Protection of Intellectual Property Rights
The programs, software, and all website content employed by LinkedMarts Limited, including but not limited to product information, images, files, website frameworks, website interface infrastructure, and webpage designs, and user content, shall in all cases constitute intellectual property rights legally in the possession of LinkedMarts Limited or other rights holder. Such intellectual property rights shall include but not be limited to trademarks, patent rights, copyrights, trade secrets, and proprietary technologies. No persons may willfully use, modify, reproduce, broadcast, transmit, publicly perform, adapt, disseminate, distribute, publish, restore, decode, or disassemble of said intellectual property. You may not quote, reprint, or reproduce the above-mentioned programs, software, and website content, without prior written permission from LinkedMarts Limited i or the copyright owner, except when clearly permitted by the law. You must fulfill your duty to respect intellectual property rights, or bear full responsibility for any damage. In order to market and promote our services, product or service names, images, or other propriety materials related to these services belonging to LinkedMarts Limited and its affiliates (“LinkedMarts Limited Trademarks”) are protected by the Trademark Act and Fair Trade Act of 2010 (Hong Kong) according to their registration or usage. You agree not to use LinkedMarts Limited Trademarks in any way, without prior written permission from LinkedMarts Limited.
13. Disclaimer
Users should stay alert when sharing your personal information on the internet. The risk of your personal information being copied, downloaded, edited or used in illegal means, should be borne by the users. Hence, users should understand the risk mentioned also exists when using the service provided by LinkedMarts Limited. The risk (including but not just limiting to any tort actions related to the third party) should be borne by the user. LinkedMarts limited would not take any responsibility for any cost incurred from the risk.
According to the corresponding law, LinkedMarts Limited solemnly reminds our fellow users to take all legal responsibility when uploading, publishing, sending, or using any other means spreading any words, software, music, voice records, photos, graphics, videos, messages, or any other information (defined as ‘content’ below) via the platform of LinkedMarts Limited.
LinkedMarts Limited has no rights to control the content spread via our platform. Thus, the authenticity, comprehensiveness as well as the quality cannot be ensured. LinkedMarts would not take any responsibilities for any content published by other individuals or parties. But LinkedMarts Limited has the right to terminate the spread of content or erase the content.
14. Indemnity
You agree to indemnify us and hold us all harmless from any claim, loss, damage, cost, expense (including legal expenses) or other liability which may be incurred by us arising out of any breach of the covenants, warranties, representations and agreements herein.
15. Notices
LinkedMarts Limited may communicate legal or other relevant regulatory notices, including those regarding changes to the TOS, using but not limited to the following channels: email, postal mail, SMS, MMS, text message, postings on our services’ webpages, or other reasonable means now known or hereafter developed. Such notices may not be received if you violate this TOS by accessing our services in an unauthorized manner. Your agreement to this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed our services in an authorized manner.
16. Termination
You agree that LinkedMarts Limited may, at its own discretion, terminate, limit access to, or suspend your LinkedMarts Limited account (or any portion thereof), or the usage of these services, or remove or delete any “member content” within these services for any reason. Reasons for termination, access limitation, or suspension include, but are not limited to, (a) extended periods of inactivity, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to LinkedMarts Limited services (or any part thereof), (d) unexpected technical or security issues or problems, (e) engagement by you in fraudulent or illegal activities, (f) nonpayment of any fees owed by you in connection with the Yahoo Services, and/or (g) breaches or violations of the TOS or other incorporated agreements or guidelines. In addition, you agree that LinkedMarts Limited may, according to its discretion, with or without notice, at any time terminate or limit your usage of these services or any portion thereof. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in LinkedMarts Limited’s sole discretion and that LinkedMarts Limited shall not be liable to you or any third party for any termination of your account or access to these services.
17. General
17.1. Where in these terms representations and warranties are made to us and to suppliers of merchandise through our site, you acknowledge and agree that such representations and warranties are intended to grant rights to, and operate for the benefit of, all such suppliers and that each such supplier may rely upon and enforce such representations and warranties against you.
17.2. We reserve the right at any time without notice to revise the content of our site (including the services offered by us) and these terms and conditions. Any changes to these terms and conditions will be posted on our site and by continuing to use our site following any such change you will signify that you agree to be bound by the revised terms and conditions of use. This right includes the right to change any of the documentation which forms part of these terms and conditions.
17.3. We take privacy issues seriously. Our privacy policy covers our use of any information you provide. In using our services, you agree that we may collect, store, and use information about you in accordance with our privacy policy. You acknowledge and agree to be bound by the terms of our privacy policy.
17.4. We reserve the right at our sole discretion to any person access to our site or any part of our site without notice and to decline to provide our services to any person that is in breach of these terms and conditions.
17.5. We shall not be liable to you for any breach of these terms and conditions of use or any failure to provide or delay in providing our services through our site resulting from any event or circumstance beyond our reasonable control.
17.6. If any clause hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other clause and such invalid clause shall be deemed to be severed from these terms and conditions.
17.7. We may assign these terms and conditions or appoint any third party, including our group companies, to provide the services to you on our behalf or to perform any of our obligations under these terms and conditions.
17.8 You shall not assign or otherwise deal with its rights and obligations under these terms and conditions, whether in whole or in part without our written consent.
17.9 These terms and conditions set forth the entire agreement and understanding of the parties and supersede all prior oral or written agreements, understandings or arrangements relating to the subject matter of these terms and conditions. Neither party shall be entitled to rely on any agreement, understanding or arrangement that is not expressly set forth in these terms and conditions.
17.10. These terms and conditions are governed by the laws in force in Hong Kong. You agree to submit to the exclusive jurisdiction of Hong Kong courts.

3. 您的註冊義務
為了能使用本服務，您同意以下事項： (a) 依本服務註冊表之提示提供您本人正確、最新及完整的資料， (b) 維持並更新您個人資料，確保其為正確、最新及完整。若您提供任何錯誤、不實或不完
整的資料，LinkedMarts 有權暫停或終止您的帳號，並拒絕您使用本服務之全部或部份。
4. 會員帳號、密碼及安全
完成本服務的登記程序之後，您有責任維持密碼及帳號的機密安全。您並同意以下事項：(a)您的
密碼或帳號遭到盜用或有其他任何安全問題發生時，您將立即通知 LinkedMarts，且(b)每次連線完
畢，均結束您的帳號使用。
用戶註冊成功後，LinkedMarts 將給予每個用戶一個用戶帳號及相應的密碼，該用戶帳號和密碼由
用戶負責保管;用戶應當對以其用戶帳號進行的所有活動和事件負法律責任。
用戶須對在 LinkedMarts 的註冊信息的真實性，合法性，有效性承擔全部責任，用戶不得冒充他
人（包括但不限於冒用他人姓名，名稱，字號，頭像等足以讓人引起混淆的方式）開設賬號;不得
利用他人的名義發布任何信息;不得惡意使用註冊帳戶導致其他用戶誤認;否則 LinkedMarts 有權立
即停止提供服務，收回其帳號並由用戶獨自承擔由此而產生的一切法律責任。
用戶理解且確認，其在 LinkedMarts 註冊賬號的所有權及有關權益均歸本公司所有，用戶完成註
冊手續後僅享有該賬號的使用權。您的賬號僅限於您本人使用，未經本公司書面同意，禁止以任
何形式贈與，借用，出租，轉讓，售賣或以其他方式許可他人使用該賬號。如果本公司發現或者
有合理理由認為使用者並非賬號初始註冊人，公司有權在未通知您的情況下，暫停或終止向該註
冊賬號提供服務，並有權註銷該賬號，而無需向註冊該賬號的用戶承擔法律責任。
為了充分使用賬號資源，如用戶在註冊後未及時進行初次登錄使用或連續超過二個月未登錄賬號
並使用等情形，本公司有權收回用戶的註冊賬號。
LinkedMarts 將採取先進的技術手段，嚴密的內控制度等保護用戶的隱私信息，關於用戶隱私信息
的收集，使用，存儲及披露等，詳見“LinkedMarts 用戶私隱政策”。
5. 物流
發貨日期會在下單後兩日之內出貨。
6. 退款、換貨及取消訂單條款
LinkedMarts 為連接不同商戶和消費者的平台，固此一切退款、換貨及取消訂單條款由商戶作最終決定。
8. 您提供的內容
您在本服務或透過本服務上傳、張貼、寄送、收受、儲存或以其他方式提供的內容，包括但不限
於文字、圖像、影音及評價等（以下簡稱「內容」），即表示您聲明並保證您擁有所有必要的權
利及/或許可，且可依照本條款供 LinkedMarts 利用。
您同意授予 LinkedMarts 非專屬、全球性、免權利金、不可撤銷、永久的、可再授權、可轉讓、
繳足及免版稅的特許權利，在本服務或經由本服務或與本服務相關之管道，使用、複製、修改、
創作衍生作品、翻譯、散布、授權、儲存、傳輸、改編或其他任何開發方式利用該內容。
LinkedMarts 得任意利用內容，包括但不限於透過信件、顯示在第三方網站、廣告媒體或其他管
道。
您也了解並同意對於您所提供的內容及 LinkedMarts 因使用內容而產生之一切請求、損失，均由
您負完全的責任。您擔保此些內容不侵害、不當利用或違反他人的專利權、著作權、商標權、營
業秘密、人格權、其他財產權、智慧財產權、肖像權、隱私權或任何適用法律或法規。
於並無限制的情況下，閣下授予我們的權利包括向各網站用戶授出再授特許的權利以於網站功能
不時許可的情況下使用用戶內容。閣下謹此放棄及促使用戶內容的所有其他原創人放棄用戶內容
的所有精神權利（包括識別用戶內容的原創人的權利或反對任何用戶內容的受貶損處理的權利）
，而不論有關權利目前或於日後任何時間在世界任何地方是否存在。
為了協助其他語言的會員了解本服務，我們提供部分或全部的翻譯服務。本服務包含由 Google 翻
譯提供的服務，Google 不提供任何明示或默示的擔保，包含但不限於正確性、可信性、商業適售
性、特定目的之適用性及未侵害他人權利。LinkedMarts 亦不保證翻譯結果的正確性及品質，會員
對於檢視、確認翻譯結果的正確性，應自行負責。
9. 兒童及青少年之保護
兒童及青少年上網已經成為無可避免之趨勢，使用網際網路獲取知識更可以培養子女的成熟度與
競爭能力。然而網路上的確存有不適宜兒童及青少年接受的訊息，例如色情與暴力的訊息，兒童
及青少年有可能因此受到心靈與肉體上的傷害。因此，為確保兒童及青少年使用網路的安全，並
避免隱私權受到侵犯，家長（或監護人）應盡到下列義務：
a.先檢閱各該網站是否有保護個人資料的「隱私權政策」，再決定是否同意提出相關的個人資料；
並應持續叮嚀兒童及青少年不可洩漏自己或家人的任何資料（包括姓名、地址、電話、電子郵件
信箱、照片、信用卡號等）給任何人。也不可以單獨接受網友的邀請或贈送禮物而與之見面。
b.謹慎選擇合適網站供兒童及青少年瀏覽。未滿十二歲之兒童上網時，應全程在旁陪伴，十二歲以
上未滿十八歲之青少年上網前亦應斟酌是否給予同意。
10. 使用者的守法義務及承諾
您承諾絕不為任何非法目的或以任何非法方式使用本服務，並承諾遵守香港相關法規及一切使用
網際網路之國際慣例。您若係香港以外之使用者，並同意遵守所屬國家或地域之法令。您同意並
保證不得利用本服務從事侵害他人權益或違法之行為，包括但不限於：
A. 上載、張貼、公布或傳送任何誹謗、侮辱、具威脅性、攻擊性、不雅、猥褻、不實、違反公共
秩序或善良風俗或其他不法之文字、圖片或任何形式的檔案於本服務上；
B. 侵害他人名譽、隱私權、營業秘密、商標權、著作權、專利權、其他智慧財產權及其他權利；
C. 違反依法律或契約所應負之保密義務；
D. 冒用他人名義使用本服務；
E. 上載、張貼、傳輸或散佈任何含有電腦病毒或任何對電腦軟、硬體產生中斷、破壞或限制功能
之程式碼之資料；
F. 從事不法交易行為或張貼虛假不實、引人犯罪之訊息；
G. 濫發廣告郵件、垃圾郵件、連鎖信、違法之多層次傳銷訊息等；
J. 以任何方法傷害未成年人；
K. 偽造訊息來源或以任何方式干擾傳輸來源之認定；
L. 干擾或中斷本服務或伺服器或連結本服務之網路，或不遵守連結至本服務之相關需求、程序、
政策或規則等，包括但不限於：使用任何設備、軟體或刻意規避 LinkedMarts 之排除自動搜尋之
標頭 (robot exclusion headers)；
M. 追蹤他人或其他干擾他人或為前述目前蒐集或儲存他人之個人資訊；
O. 其他 LinkedMarts 有正當理由認為不適當之行為。
11. 系統中斷或故障
本服務有時可能會出現中斷或故障等現象，或許將造成您使用上的不便、資料喪失、錯誤、遭人
篡改或其他經濟上損失等情形。您於使用本服務時宜自行採取防護措施。LinkedMarts 對於您因使

及侵權或有所不實，請逕向該內容提供者反應意見。
13. 廣告
您在本服務中瀏覽到的所有廣告內容、文字與圖片之說明、展示樣品或其他銷售資訊，均由各該

程、解編或反向組譯。若您欲引用或轉載前述軟體、程式或網站內容，除明確為法律所許可者外

16. 終止
您同意 LinkedMarts 得依其判斷因任何理由，包含但不限於一定期間未使用、法院或政府機關命
令、本服務無法繼續或服務內容實質變更、無法預期之技術或安全因素或問題、您所為詐欺或違
法行為、未依約支付費用，或其他 LinkedMarts 認為您已經違反本服務條款的明文規定及精神，
而終止或限制您使用帳號（或其任何部分）或本服務之使用，並將本服務內任何「會員內容」加
以移除並刪除。您並同意 LinkedMarts 亦得依其自行之考量，於通知或未通知之情形下，隨時終
止或限制您使用本服務或其任何部分。您承認並同意前開終止或限制，LinkedMarts 得立即關閉、
刪除或限制存取您的帳號及您帳號中全部或部分相關資料及檔案，及停止本服務全部或部分之使
用。此外，您同意若本服務之使用被終止或限制時，LinkedMarts 對您或任何第三人均不承擔責
任。
17. 一般條款
17.1 倘於此等條款中的聲明及保證乃透過我們的網站向我們及商品供應商所作出，閣下確認及
同意有關聲明及保證乃旨在向所有有關供應商授出權利及為所有有關供應商的利益作出，而有關
